Family Law Litigation Attorneys in Folsom

Resolving Disputes through Litigation

By definition, litigation is the process in which legal action is taken to resolve a dispute. Though it is often simpler to resolve a family matter without resorting to litigation, sometimes litigation is the only way to find a solution. Our family lawyers in Folsom have extensive trial experience to put to work for you. We can walk you through every step of the process and ensure that your rights and interests are protected.

Contact the Law Office of Tiffany L. Andrews, P.C. today if you need representation for family law litigation. Call (916) 794-4576.

The Litigation Process

Typically, someone will file a summons and petition and, at times, additional moving papers in court seeking some form of relief. Then, the other side will respond. Usually, once the legal case begins, there is an exchanging of information either informally or formally. This is otherwise known as the discovery period.

After discovery is completed, most courts require the parties to attend a settlement conference to determine if the case may be resolved before trial. If the parties are unable to reach a settlement, the litigation continues to a trial.

Near or on the day of trial, one or both parties often make settlement offers, in the hope of avoiding court proceedings (which are often costly and protracted). Litigation ends if a settlement is reached. However, if not, a trial will commence. In family law and juvenile dependency proceedings, the trials are conducted by a judge – not a jury.

During a trial, both parties present relevant and admissible evidence that will help to prove the truth of their positions. If the moving petitioner makes a convincing case, the respondent may seek to settle the case immediately. On the other hand, if the petitioner presents a weak case, the respondent may ask the court to dismiss the case. If the trial proceeds to a conclusion, the judge must decide which party prevails. Once the Court makes a final decision, the losing party has the right to file a timely appeal.

  • “Excellent Process and Assistance”
I'd like to thank Tiffany for her advice. I've been divorced for over a year and am still trying to collect on the settlement agreement. I had a question about the legal interest and if it's collectible and she said definitely! as long as the judgment doesn't preclude it. She was extremely helpful - also offering other remedies to assist in the collection of the funds. I would definitely call her again if I need more help.

  • “The BEST”
We have been her clients for about 7 years now. We first hired her when she was working with another law firm. We were so impressed and pleased with her that we followed her when she started her own law firm. She is very kind, understanding, and has always advised us in the right direction. She's helped us with multiple cases and is always on top of it. We definitely couldn't have done it without her help. We highly recommend her. She also has a great staff. They are always quick to respond and very helpful.

  • “Family Called by CPS”
Was called by CPS for the first time. We were scared, didn't know what to do or say. Didn't have any idea how to handle an unfortunate situation like this. Just because of a false accusation, our lives changed! Called a friend and referred me to Tiffany who's an expert in this kind of situations. Tiffany was there to answer all our questions, gave us advice and cleared our minds. She explained the situation in a manner that we will understand and assured us that everything will be fine. Those were the words that we needed to hear. We followed her advice and Thank God everything went well. Thank you, Tiffany!
